Remote Work from Overseas

Remote work is common while traveling abroad for conferences, collaborations, and meetings.   However, in some instances, faculty, staff, and/or students may request to work remotely on a full-time or reduced effort basis while abroad.  Several factors should be considered for working remotely overseas.

Export Control Review and Other Considerations 

• What is the location of the remote work?

  Certain countries (Countries of Concern (China, Iran, North Korea, and Russia) and OFAC Sanctioned Countries) will present a higher risk for remote work due to in-country laws and regulations regarding issues such as privacy and/or security.

• When does a Restricted Party Screening need to be completed?

  If you are working remotely from a business or university setting, then a Restricted Party Screening should be completed.

• What is the scope of research being performed?

  The following types of research projects should not be conducted outside the U.S by a remote worker: 

  • Prior approval of publications 
  • Prior approval of foreign nationals 
  • Subject to a Technology Control Plan 
  • Subject to increased cybersecurity controls 
  • Export-controlled projects 
• Is the research funded by a federal sponsor?
  If the research is funded by a federal sponsor, check with the Office of Sponsored Programs to confirm that there are not any sponsor approval requirements in your grant or contract to work outside of the U.S. 
• Is any equipment, software. or data required in the foreign country?
  If the research work requires that you take equipment, software, or data to the foreing location, review the International Transfers: Shipments, Hand-Carry and Electronic Transmissions Guidance or contact the Export Control Compliance Team. 
• Is the remote worker in the U.S. on a visa?

  A national of a comprehensively sanctioned country (such as Iran or Cuba) who is here under a valid visa is authorized to work in the U.S. only.  Additional authorizations from the Federal Government may be required for a foreign remote work arrangement for such a visa holder.
