You have the right to report any incident of sexual misconduct that you believe may also be a crime to the University, local and or state police.

Reporting to Law Enforcement

You may report the incident through the University Police Department (UPD) or if you prefer, through state or local police.  Upon reviewing the facts of your case, a law enforcement agency will investigate the report and may arrest the accused. Thereafter, the District Attorney may decide to prosecute the matter. If so, you may be required to testify in court. Once criminal charges are initiated, you cannot withdraw charges without the consent of the District Attorney’s Office.

If you choose to pursue criminal charges and also wish to report to OEA, it is possible that Stony Brook’s internal fact-finding process may be temporarily suspended while the criminal investigation is conducted.

The criminal justice process utilizes a different standard of proof than the University process.  Any questions about whether a specific incident violated the penal law should be addressed to law enforcement or the District Attorney.

You have the right to make a report to University Police, local law enforcement and/or state police or choose not to report; to report the incident to the University, to be protected by the University from retaliation for reporting an incident; and to receive assistance and resources from the University.
